New Regulations Announced

LEXINGTON, Ky. (July 21, 2011) — New Administrative Regulations have been established at the University of Kentucky.

This revision creates an entrepreneurial leave for faculty employees who wish to take time off from their University position to pursue entrepreneurial activities. Faculty employees desiring to take entrepreneurial leave must submit a completed and signed “Entrepreneurial Leave Form” and all attachments.  The leave must be recommended by the faculty employee’s unit administrator and approved by the dean of the college and the Provost.  Specific terms and conditions for entrepreneurial leave are found in the Governing Regulation and the Entrepreneurial Leave Form.  The form may be obtained from the Office of the Provost.

This Administrative Regulation is revised to assign final approval to the Provost in tenure and promotion cases. Previously, the President rendered the final judgment on a tenure or promotion dossier in a comprehensive tenure review, which created an untenable situation for the subsequent appeals process after a negative decision. Typically a formal appeal is lodged in the office one step higher in the reporting structure of the University, and in a decision to deny the granting of tenure, the university official who adjudicates an appeal must review the case with an unformed opinion.  Furthermore, most tenure appeals are routed through the Senate Appeals Committee on Privilege and Tenure, which advises the President on such matters.  The revision also includes minor editorial changes, intended to enhance the readability of the document.

This regulation is revised to include entrepreneurial leave as a type of leave for which a faculty employee may make up his/her retirement contributions following the leave.  In addition, the regulation is amended to include the 457(f) plan as a plan option for retirement contributions that the University may make to provide retention incentives.

This new Administrative Regulation establishes policies and procedures for international education travel that is approved or sponsored by the University, whether credit-bearing or non-credit-bearing.  Participants in international education travel are required to apply or register their travel experience with the Office of International Affairs (OIA) and comply with all other requirements established by the regulation. The regulation: a)  outlines the roles and responsibilities of the administration, faculty and staff, and students and trainees involved in education abroad; b) creates an Education Abroad Advisory Committee within the University; and, c) establishes policies for credit transfer, grading, insurance, and risk management.

This regulation establishes the minimum gift amounts and other endowment requirements for private funding of academic positions, undergraduate scholarships, and faculty and graduate fellowships.  This regulation also establishes minimum gift amounts and requirements for naming University programs, units, and properties.
